Restaurant Servers Often Entitled to Higher Rate of Pay

The restaurant industry is one with many legalities, and the method in which waiters and waitresses are paid is certainly no exception.

Are you a waiter or waitress who is spending more than 20 percent of your time doing tasks that are not related to serving customers, such as folding silverware, cleaning floors, and restocking dishes? You’re likely not being tipped for these tasks, which means you may not be getting the hourly rate you deserve.

It happens all the time. In 2016, Ruby Tuesday servers and bartenders filed a lawsuit stating that more than 20 percent of the servers’ shifts were spent doing tasks like cutting lemons, refilling ice bins, and rolling silverware.

You may be entitled to a higher rate of pay if completing such side tasks takes up more than 20 percent of your time at work.
